Approval to Partition

PAENOA TE AKAU - MAORI LAND COURT SPECIAL HEARING
MON
17 SEP
2012
Time 11:30am Location TAUPO DISTRICT COURT, Taupo
Submitted by Application for Partition by Ngahuia Ripeka Whanau Trust (not verified)
Panui 147, Section 289/93 Application to Partition

This application by Ngahuia Ripeka Whanau Trust (NRT) has been awaiting a hearing since early 2009, due to various challenges within the Paenoa Te Akau Ahu Whenua Trust. We have also prepared an application for the Rangitopeora Whanau Trust and their application was submitted in tandem with NRT. There are also several other applications for partition which are to be heard on the same day, in conjunction with ours.

In November 2011 the AGM for Paenoa Te Akau was called and held under the specific direction of Judge Savage, Maori Land Court. Voting was 100% positive that "those who wish to partition should be allowed the opportunity to do so" although there were a couple who abstained from voting at the AGM due to lack of knowledge of the situation.

Our application was to be heard on 30 March 2012 but was once again adjourned, due to the Court not having prepared beforehand, with all necessary information before the Judge, which we (and other applicants from other whanau trusts) had prepared and submitted.

This has allowed further deliberation by the present Ahu Whenua Trustees (who are all in agreeance that we should be permitted to partition our land if we choose to) and also for Judge Savage to be at the helm on the day.

WE ARE HAPPY TO ANNOUNCE THAT THE MAORI LAND COURT HAVE APPROVED OUR APPLICATION TO PARTITION PAENOA TE AKAU PENDING SURVEY COMPLETION WITHIN SIX (6) MONTHS.
