Operation 8 Court Report 23rd August 2010

in

A one-week hearing started at 10am in the Auckland High Court in relation to the 15th October 2007 raids. Several applications, both from the crown and the defence, are being heard this week. Details can't be reported, so there isn't really that much to say about the hearing.

A few defendants and supporters were at Court all day in room 14. Justice Helen Winkelmann is again presiding over the hearing. The crown is represented by Ross Burns and Emma Finlayson-Davis, while 12 defence lawyers were in Court today. Special Investigation Group cops Aaron Lee Pascoe and Eamonn P Whelan were also lurking around.

The hearings will continue on Tuesday, Thursday and Friday and are open to the public.

It can be said that the prosecution seeks to keep the trial in Auckland and before a judge alone. The defendants seek to move the trial to Rotorua and before a jury. The defendants never consented to the case being moved to Auckland in the first place. The court shifted proceedings to Auckland as the defendants sat in jail on unfounded terrorism allegations.

The application for trial by judge alone is another tactical maneuver by the prosecution and their desperate police accomplices in the case to ensure that the accused do not have a fair trial.

There is no expectation of decisions on anything immediately.
